Terms of Use

All graphics, digital art and photography on this site have been created by the Artist, Tina Marringer of GrannysGraphics.Com and are protected by copyright laws.  Nothing on this site may be copied, downloaded or used without permission.  All custom graphics cannot be resized, redistributed or altered in anyway or used in any other creation.  If you purchase a custom graphic made specifically for your business or website from GrannysGraphics.Com, and you need to change something later on, you can contact us so we can remake the graphic for you and pricing terms can be discussed at that time.  Custom Graphics vary in price and are made on a case by case basis per each client's needs.  Delivery of all graphics whether they are custom made or pre-made will be delivered via email after payment has been made and cleared through PayPal.Com.  

GrannysGraphics.Com may require a 50% down payment for larger custom orders before creating them.  The remaining 50% would be paid when the project is finished.  All pre-made graphics are sold as is and once the customer has paid for them, they may use the graphic on their personal or business website or for online projects only.  Some pre-made graphics can be resized; note the descriptions under each graphic to see what can be changed or not changed.  Once the graphics are purchased from GrannysGraphics.Com you may not use them to make new graphics, offer them for sale, reconstruct them or claim them as your own creations; the original copyrights belong to GrannysGraphics.Com even though you purchase them and they are on your site.  If you need a "pre-made graphic" resized smaller than the original, the first resizing is free but every resizing after that will cost 2.00 each.  

All terms herein represent GrannysGraphics.Com and the Artist, Tina Marringer.  GrannysGraphics.Com and the Artist makes no representations about any other website which you may access through this site.  When you access another site from this site, it is independent and GrannysGraphics.Com has no control over the content of such sites or the availability of such sites and a link to another site from this one does not mean GrannysGraphics.Com endorses or accepts any responsibility for the content, or the use of such websites or their Affiliates.  GrannysGraphics.Com assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of, communications, any problems or technical malfunctions of but not limited to computer online systems, servers or providers, computer equipment, software, failure of email, traffic congestion on the Internet or at any Sites or combination thereof, including injury or damage to users or to any other person's computer related to or resulting from participating or downloading materials in connection with the Web and/or in connection with the Sites. TO THE FULLEST EXTENT PERMISSIBLE PURSUANT TO APPLICABLE LAW, NEITHER GrannysGraphics.Com, The Artist, NOR ANY OTHER PARTY INVOLVED IN CREATING, PRODUCING OR DELIVERING THE SITES IS LIABLE FOR ANY DIRECT, INCIDENTAL, CONSEQUENTIAL, INDIRECT, SPECIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS ARISING OUT OF YOUR ACCESS TO, OR USE OF, THE SITES EVEN IF GrannysGraphics.Com has BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. WITHOUT LIMITING THE FOREGOING, EVERYTHING ON THE SITE IS PROVIDED TO YOU "AS IS" WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESSED OR IMPLIED.  

These Terms of Use, and any and all disputes, issues, controversies or matters arising here from or related hereto or otherwise arising from or related to the Sites, Materials or Content, shall be governed by and in accordance with the laws and decisions of the State of Missouri, without giving effect to its choice of law or conflict of law provisions. You agree that the state and federal courts sitting in Ozark, Missouri shall be the exclusive forum for the resolution of any and all disputes, issues, controversies or matters arising here from or related hereto or otherwise arising from or related to this site and it's Materials or Content, and that any such disputes, issues, controversies or matters shall be resolved individually, without resort to any form of class action. You hereby consent to personal jurisdiction and venue in Ozark, Missouri and service of process by certified mail. 

You agree to indemnify, defend and hold harmless, GrannysGraphics.Com, the Artist and our Affiliates, and their respective agents, licensors, representatives, and third party providers to the Sites from and against all losses, expenses, damages and costs, including reasonable attorneys' fees, resulting from any violation of these Terms of Use by you. 

GrannysGraphics.Com has the right to change the Terms of Use, Privacy Policy or anything to do with GrannysGraphics.Com and if such items are changed, the changes will be posted to the site within 24 hours.  By using this site you agree you are at least 18 years old and you will abide by these Terms of Use and the Privacy Policy herein.  If you have any questions or comments regarding this site please send your email via the Contact Us page and we will reply back to you within 48 hours.
